Breathy is a technology platform that connects patients with healthcare professionals ("Providers") for online and in-clinic consultations, health record management, and other related services. Breathy is not a healthcare provider. We do not provide medical advice, diagnosis, or treatment. Any information provided on the Platform is for informational purposes only. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

2. User Accounts

• Eligibility: You must be at least 18 years old to create an account.
• Account Types: We offer different account types, including for Patients and Providers.
• Provider Verification: All Providers on the Platform undergo a verification process. However, Breathy does not guarantee the credentials or quality of services of any Provider.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Subscription Services ("Breathy Pro")

• Free Tier: All users begin on a free plan with limited features.
• Paid Subscriptions: We offer paid subscription plans ("Breathy Pro") which provide access to premium features.
• Billing: Subscriptions are billed on a recurring basis (e.g., monthly, yearly) through our payment partners, Razorpay, Cashfree. You authorize us to charge your selected payment method for the subscription fees.
• Free Trials: We may offer free trials to eligible users. If you do not cancel before the end of the trial period, you will be automatically charged for the subscription.
• Changes: We reserve the right to change subscription fees. Any changes will be communicated to you in advance.

4. User Conduct

You agree not to:

• Use the Platform for any illegal purpose.
• Provide false or misleading information.
• Harass, abuse, or harm another person.
• Interfere with the operation of the Platform.
• Use the platform to share unsolicited promotions or spam.

5. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of Breathy or its licensors and is protected by copyright and other intellectual property laws.

6. Disclaimers and Limitation of Liability

The Platform is provided "as is" without any warranties. Breathy is not liable for any damages arising from your use of the Platform, including any interactions with Providers. Our liability is limited to the maximum extent permitted by law.

7. Termination

We may suspend or terminate your account at our discretion if you violate these Terms.

8. Governing Law

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in West Bengal.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on the Platform.
